No one looks forward to going under anesthesia—for good reasons. Under the best of circumstances, there may be unanticipated risks. Kristen Hull, an experienced nurse anesthetist, shares with us how anesthesia mishaps can occur and what best practices can prevent them. Because an LNC is likely to get involved in a malpractice suit involving anesthesia, this podcast has particular value to you.
Kristen emphasizes the importance of speaking to the patient prior to anesthesia and of checking possible difficulties with the procedure. This process also helps her know what particular forms of equipment will be needed.
It is vital, she says, to determine whether the patient has recently eaten. Unfortunately, people don’t always tell the truth, and some of them aspirate what they ate and may die. Kristen always explains the consequences of lying, and she has probably saved lives by doing so.
Kristen candidly states that inattention during the operation can cause problems. It’s important to stay alert during all phases of the surgery and afterwards.
Kristen acknowledges that greater opportunities for error exist when an anesthesiologist isn’t directly available, as can be the case in PACUs. That requires a greater degree of attention from the anesthetist.

Pat Hirsch, a nurse who has a depth of experience in critical care and PACU units, describes some of the common types of liability in this setting and how PACU personnel handle them.
The possibility of falling always looms large in a PACU. Patients may be disoriented, have pre-existing cognitive issues, visual disturbances, language barriers, and other issues. Where Pat works, low-, medium-, and high-risk patients are pre-identified. High-risk patients are given yellow socks and wrist bands, and other precautions are set into place.
Breathing issues may be common for those with COPD, lung restrictive conditions, and sleep apnea. CO2 levels must be monitored. Many simple physical techniques, like having a conscious patient cough, can resolve the issues, but sometimes more complex maneuvers are required. Being sure that pulse ox monitors are working correctly is an important part of the equation.
PACU personnel need to be particularly aware of the possibility of internal bleeding by recognizing its signs. This serious condition may sometimes require a return to surgery.

My name is Patricia Hirsch and I’m from Cincinnati, OH. I’ve been an active bedside nurse for almost 39 years. My nursing experience includes Med-Surg, Telemetry, CCU, ICU, MICU, SICU, ED, Pre op and PACU. I’ve been working in a PACU for the past 16 years, along with pre op in the past 10 years. My clinical experience in Critical Care and PeriOp nursing has fostered my knowledge of the nursing process and standards of care in nursing.
I also worked in many different hospital settings and worked for a nursing agency for 10 years. This broadened my knowledge in how different healthcare systems operate.

Nursing home falls make up a substantial portion of malpractice suits. Here to help you understand the dynamics of the circumstances surrounding falls is Tina Baxter. She is a legal nurse consultant, nurse practitioner, and certified gerontological nurse.
She first addresses the issue of hydraulic lifts, which can be the cause of many falls. Sometimes the age and quality of the lift plays a role. Sometimes one person isn’t enough to manage it. Tina recommends that the LNC reviewing a case always look to see if a hydraulic lift was involved.
Misdiagnosis can sometimes be over whether the individual has Type 1 or Type 2 diabetes. Since different treatments are required for the two major forms of diabetes, misdiagnosis can be a major problem. When the possible presence of diabetes is not tested for in emergency situations, life-threatening crises may develop.
Tina states that often CNAs are afraid to report a fall. She emphasizes that to not do so involves severe legal consequences. Any fall must be reported immediately, and she describes the usual procedure for reporting a fall through the chain of command..
Contributing issues to the severity of a fall may be a LPN’s unfamiliarity with the potential consequences of medications. Blood thinners are a prime example. Anyone administering medication to a resident needs to understand its properties.
Finally, she describes situations in which the nursing home personnel is not legally responsible for a fall. Patients who shouldn’t try to get out of bed and into a wheelchair. They may experience sudden drops in blood pressure and fall. This is why the LNC needs to closely investigate any fall situation.

Nurse practitioners (NPs) play an essential role in primary care and other medical settings. Increasingly, they are being named as defendants in malpractice suits. Rebecca Paschall, who both works as an NP and a legal nurse consultant, shares her experience in these areas of expertise. She learned that her LNC work deepens her diagnostic and analytical abilities in her clinical work.
Rebecca also finds many opportunities to instruct other clinicians on her job about best medical practices.
She finds that the most common medical areas in primary care involve failure and delay in diagnosis and misdiagnosis. Within that umbrella, cancer, diabetes, sepsis, and cardiac issues assume primary importance. Rebecca believes that a problematic case requires discussion with other clinicians and often consultation with the supervising physician.
Also, Rebecca emphasizes that it can be essential to get the physicians to state circumstances in which they want to be consulted or to see diagnostic test results and other critical data. This for her is part of an overall emphasis on good communication among all employees in a primary care setting.
