Even the experienced LNC may wonder how to best inform an attorney that his or her case lacks merit, especially when it’s clear that this attorney has become invested in the case. Pam Di Gennaro, a highly experienced LNC, provides a practical guide on how to let attorneys down easily by speaking to them in the language of tort law.
Another issue arising from a case without merit may be an unwelcome call from the plaintiff. She explains the ethical and compassionate response.
Pam is not only skilled at LNC etiquette; she has had the unique experience of being an Army wife who had to reestablish her practice every time her family had to move. Her techniques and positive approach can benefit any LNC.
She also gives a detailed summary of the positive and negative aspects of getting involved in mass tort litigation. Pam recommends it for a new LNC because it provides a steady paycheck and extensive experience. Science and Law have always interested me. After a stint as a medic in the US Army, I finished college (West Chester, PA) with a Political Science BA and minors in Physics and Journalism. Beginning my paralegal career with a defense firm in Paoli, I obtained my paralegal certification from Villanova. Immersed in healthcare review, I reawakened my desire to be a nurse at the ripe age of 33. I gravitated to Med-Surg and then to nursing homes as these venues allow me to more intimately interact with patients and their families. Frequently I found myself advising others on care and charting pitfalls, based on my paralegal past. A chance introduction with an early pioneer in Legal Nurse Consulting in 1995 changed my career focus joining both Law and Nursing. I went all-in obtaining my LNC certification (AALNC) and my Master of Juris-Health Law from Loyola. I’ve worked in-house both plaintiff and defense, with independent LNC firms, and freelance. And I still pull PRN shifts at a local nursing home because I enjoy it!

After a long, pandemic-induced lull, attorney conferences have made a comeback. These events provide LNCs with a unique opportunity to meet prospective clients face to face. Angel Hickerson and your host, Pat Iyer, share advice on how to get the most out of these exhibiting conferences.
Perhaps the most important recommendation is to be professional in every way. Dress appropriately, stay off your cell phone, don’t deluge your prospect with too much information about your practice, and make sure the appearance of your booth reflects your business colors.
Don’t leave your booth unattended; have a companion who can answer questions when you take a needed break.
Be patient. If you are at a three-day conference, recognize that the attorneys have a lot to accomplish. If they get to you before you leave, you’ve succeeded.
That same level of patience plus persistence is necessary in the follow-up process. Angel never gives up, and often, three or six months later, the attorney remembers her and gives her a call.
This conversation between two veteran conference attendees will give you the information you need to return to one of the most fruitful areas for LNCs looking for new clients.

Angel is the owner and certified legal nurse consultant of Guardian Angel Consulting, LLC, in Albuquerque, New Mexico. She earned her Masters in Nursing in Clinical Trials Research from Drexel University. Her thirteen years of nursing experience have included postpartum OB, high-risk pregnancy, pediatric intensive care, case management, and utilization review. Cheryl Gatti, who has been an experienced LNC for over 30 years, compares the early days of LNC work with the current environment and has valuable recommendations for any LNC to improve their business.
She considers the AALNC a useful resource and encourages chapter membership. She recommends a self-assessment for areas that need improvement and education in those areas. Of particular importance is expertise in writing and speaking with clarity.
While nurses get no formal training in the basics of running a business, they do learn critical thinking and analysis, as well as how to break down complex medical issues so that laypeople can understand them. This helps them hugely in the expert witness world.
Cheryl highly recommends that LNCS try to get their work published in journals and/or books. Not only does this give your name and brand exposure, but you will also have editors who go over your work and, through their suggestions, can help you become a better writer.
LNCs may get opportunities for high-volume volume work like mass torts. Cheryl advises that you consider whether you and/or your firm can handle it but not let fear stop you.

Does any area of an LNC’s work present greater challenges than marketing your business? How great a difference would it make to your well-being and confidence if you could learn how successful LNCs do it?
Jacquelyn Maki, a Wisconsin resident, who worked her way from being a CNA to getting a master’s degree in health care administration, knows the value of persistence, and her marketing practices reflect this value.
At the beginning of her LNC career, she targeted prospects not only on the basis of logical preferences but on a kind of intuition that told her she and a particular attorney would make a good match. In researching local lawyers, she sometimes went to court and analyzed their performances and the approached them for a conversation. She reports this as highly successful technique.
As she expanded her efforts, she initiated the goal of having lawyers in every state in the U.S. She pursues this goal today; as she says, you never stop marketing. She advocates the importance of trial lawyers’ conferences as a great way to meet attorneys.
Many LNCs hesitate about how frequently to approach an attorney. Jacque shares with you her step-by-step approach which she has designed by knowing what she doesn’t like when people are marketing to her.
