The ability to deliver an informative and easy-to-follow medical chronology can boost your LNC business. Emily Flynn, an experienced emergency department nurse, has been a legal nurse consultant since 2006. She brings her expertise to the complex subject of preparing a chronology that meets her clients’ needs.
Though this is her basic approach, she always determines the attorney’s preferred format for a chronology and also how much content the client wants. Emily finds it crucial to have a system for organizing the files and discovering when critical files are missing from the records.
Handling discrepancies is a vital part of writing a chronology. It may be necessary to delineate the variance of opinions among eyewitnesses, for example. Sometimes different doctors have varying opinions of a patient’s condition. Emily emphasizes that pointing out discrepancies is not expressing an opinion. Opinions aren’t part of an LNC’s work.

Today you’ll have an opportunity to learn from a cardiologist, pharmacologist, and author, who has brought his expertise into the world of expert witnesses. Dr. Michael Zema shares what he has learned to sharpen his expert witness abilities.
Dr. Zema has a routine of breaking up case analysis with research, which not only relieves the tedium of endless pages of documentation but gives him new insights into the case.
He describes some of the pitfalls in electronic medical records with a warning that the copy-and-paste function can propagate a medical error for years. As an example, he describes meeting a patient whose chart incorrectly stated that he’d recently had bypass surgery. When Dr. Zema discovered this error, he found that the man’s medical records had perpetuated it for two years.
Because of the frequency of pharmaceutical errors, Dr. Zema urges expert witnesses to familiarize themselves as much as possible with pharmacology. He describes a case of Stevens-Johnson Syndrome in which an incorrectly prescribed drug played a big role.
Of special value to expert witnesses and attorneys is his approach to cross-examination. He always tries to think like the opposing attorney, an approach he also uses in analyzing the medical information. Be prepared for some top-level information and guidance in this podcast.

Dr. Zema received his Medical Degree from Cornell University Medical College. He completed his post-graduate Internal Medicine training at the North Shore University Hospital in Manhasset, Long Island, with subsequent Fellowships in Cardiology there and at the New York Hospital Cornell Medical Center. He is a distinguished Fellow in the American College of Physicians, American College of Cardiology, American College of Chest Physicians and the American College of Clinical Pharmacology among others. Dr. Zema is a Certified Physician Executive of the American Association of Physician Leadership and a Six Sigma Green Belt in Healthcare. Dr. Zema has penned numerous publications in professional medical journals and most recently has authored the book “Modern Healthcare Delivery, Deliverance or Debacle – A Glimpse From the Inside Out.”

What’s the best way to create a work product when you’re working on a personal injury case? Laura Keegan, an LNC who brings to her work 28 years of widely varied nursing experience, gives you the answers you need.
Her most important piece of advice is: Always ask the attorneys what they want. You’ll get a range of responses.
Second: You may have your own ideas of how a chronology or summary should be organized, but don’t assume you’re right. Give the attorneys what they want in terms of organization, detail, and types of comments. Follow these rules, and you will have long and happy relationships with your attorney clients.
Laura extensively comments on different types of personal injuries. In addition to vehicular accidents, personal injury may include toxic torts, equipment failures, slips and falls, and other kinds of injuries. She also emphasizes the value of deep investigation of providers named in the report and the importance of reviewing bills.
She also emphasizes that, while when you find something injurious to your client’s case, you need to present the bad news with tact and care.

In a personal injury or medical malpractice case, the cost of future care plays a key role. Debbie Wuerl, a legal nurse consultant with a range of experience in nursing areas, specializes in personal injury cases and working with medical malpractice attorneys. She has particular expertise in working on cost projections
This is not the same as but is part of a life care plan. Debbie focuses on future costs that derive from the injury or other conditions: medications, future surgeries, in-patient and outpatient therapies, and other expenses associated with the condition.
While this involves carefully studying medical records, it can also entail personal investigation. She may visit patients in the hospital or in their homes. Particularly through home visits, she can gain a more in-depth perspective on the patient’s needs.
Some may have no one to drive them to medical or therapy appointments. She may learn that others don’t understand what the doctors or other practitioners are saying and may go to the practitioners and recommend that they “humanize” their communications with the client.
She summarizes her findings in an easy-to-read table format that begins her report. The accessibility of this information has, she says, helped to get many cases settled in mediation without trial.

Debbie worked primarily in Geriatrics since graduating from Milwaukee Area Technical College in 1983. Before earning her BSN completion from Cardinal Stritch University in 2001, she worked in Long Term Care, Inpatient and Sub-Acute Rehabilitation, home care, and in hospice care. Since earning her BSN completion, she was a Certified Case Manager in both the public and private sector insurance industry, before being a Clinical Liaison Officer to the LTC facilities in SE WI and returning to Long Term Care. She started Wuerl Legal Nurse Consulting, LLC in 2005, working with Personal Injury and Med Mal attorneys in Wisconsin and in other states.
