As a legal nurse consultant, you are sure to come across malpractice suits involving heart disease. This podcast features Erin Getz, a nurse practitioner, an expert on this subject. She unravels some of the complex issues involved in various heart conditions.
Of primary concern is management of medications. This can be very challenging to older patients, many of whom may already be juggling a number of medications. Particularly with younger people, presenting symptoms may be treated as panic attacks, asthma, and other non-cardiac conditions.
Erin emphasizes that misdiagnoses particularly occur in the case of women, who don’t always exhibit the standard symptoms of, for example, a heart attack.

We have increasing awareness of the multiple deficiencies in the U.S. medical system, particularly in hospitals. Here with an inside look at efforts to solve this, is Dianna Goodwin, a registered nurse with 28 years of varied experience. Speaking as a manager, she shares her experience in providing the best possible support for nurses in terms of training on all levels.
Dianna emphasizes the importance of having a mix of new and experienced nurses. New nurses need mentoring, and too many in need of this assistance place a burden on available resources.
Nurses especially need training in high-risk, low-frequency procedures, which can occur in any area of the hospital. Dianne explains that any nurse who hasn’t done such procedures in a long time may need supervision.
Dianne pays particular attention to the need for nurses to understand the chain of command and how to work within it when they feel a doctor has given them an inappropriate instruction. She illustrates this principle with a detailed and fascinating story about an incident where she had to intervene to support a nurse who needed to challenge a doctor’s instruction.

No one looks forward to going under anesthesia—for good reasons. Under the best of circumstances, there may be unanticipated risks. Kristen Hull, an experienced nurse anesthetist, shares with us how anesthesia mishaps can occur and what best practices can prevent them. Because an LNC is likely to get involved in a malpractice suit involving anesthesia, this podcast has particular value to you.
Kristen emphasizes the importance of speaking to the patient prior to anesthesia and of checking possible difficulties with the procedure. This process also helps her know what particular forms of equipment will be needed.
It is vital, she says, to determine whether the patient has recently eaten. Unfortunately, people don’t always tell the truth, and some of them aspirate what they ate and may die. Kristen always explains the consequences of lying, and she has probably saved lives by doing so.
Kristen candidly states that inattention during the operation can cause problems. It’s important to stay alert during all phases of the surgery and afterwards.
Kristen acknowledges that greater opportunities for error exist when an anesthesiologist isn’t directly available, as can be the case in PACUs. That requires a greater degree of attention from the anesthetist.

Some of the biggest damages in medical malpractice cases result from malpractice in the area of obstetrics. Savannah June, a legal nurse consultant with a strong background in the area of maternal-fetal medicine, describes how practitioners in this field try to ensure protection for at-risk mothers and babies and where malpractice may occur.
Maternal-fetal medicine (MFM) is a specialty of obstetrics that requires advanced training. Savannah points out that high-quality MFM care is not as widely available in the U.S. as it should be, especially in comparison to another economically advanced country.
Testing within the field of MFM is comprehensive and complex. It’s crucial to identify pre-existing conditions such as diabetes to evaluate previous problematic pregnancies, and growth abnormalities of the fetus, to name only a few of the conditions that must be identified and, when possible, treated to ensure a safe pregnancy and successful delivery.
Educating the pregnant mother is equally important. Savannah asserts that, when there are problems with the pregnancy or anticipated difficulties with the delivery, the physician is responsible for the initial explanation.
However, she also reminds us that the nurse involved is responsible for explaining what role the mother needs to play in the treatment plan and to answer any questions the mother may have. She emphasizes the special difficulties caused when the mother suffers from mental illness. Too often, these are the women who don’t come for treatment because they feel stigmatized.
